I was lead to believe I had a one year warranty.
That may not be true. More about that later.

For over a year, at each contact Stuart Sams said “I appreciate you”.

But his actions say that is not true.
Stuart Sams’ second favored statement:
“I will take care of it at the end”

He never did. Does that sound like an honest person?

Do your due diligence. There are governing bodies that are supposed to protect Clayton buyers if something goes wrong. Don’t count on them. I have over $100,000 in damages. But those who should protect me in Tennessee may not.

Incorrect pad grading began in March of 2023

a thin layer of red clay covered grass/topsoil

We had no idea this was being done, until much later!

The Tennessee verson of the Clayton Homes Construction Manual has very clear steps that are supposed to be followed to assure the house is level and stable. Those steps WERE NOT followed.

Because the pad was not properly crowned rainwater poured under my house for months, with rotting grass and topsoil directly under footing. We reported this to Stuart Sams several times, but nothing was done. ~Months passed with no correction. Each time I reported the standing water to Stuart Sams he said he would take care of it “at the end”. He didn’t. ~I told Stuart Sams that HUD required under the house be kept clean and dry. ~He said he does not follow HUD rules. ~ When I asked him to remove the mud and trash and install a clean layer of Visqueen. He said he was not going to do that, and he didn’t. ~Eventually the A/C company sent someone to clean up the mess and put down a new layer of Visqueen. ~All the low spots are still there but at least it’s clean.

Above is a section of the second, failed, “final, inspection. That inspection was called for three times before it passed. The reason for the failures was due to poor crowning and the presence of water under and around the house. There was still never an engineer’s inspection of the footings to check for topsoil (organic materials). That has never been done by Clayton Homes of Hixson, TN or Stuart Sams, even though he hired the grading company and he is aware of the existance of the rotting grass and topsoil. AND the fact that MY house is sinking. This violates his own construction manual. A compaction test was finally ordered August 24, 2023 by the state inspector over 5 months after the house was installed. NO inspection was ever done to verify if there was topsoil under the footings. The whole pad sits on 2 to 6 inches of sticky clay over topsoil and rotting grass. AND MY HOUSE IS SINKING.

So much for a compaction company’s opinion!

Please note that the compaction company only tested the soil around the house. No test was done to
verify if the soil under the house was of proper compaction. Nor was any test done to verify if the
standing water that is clearly seen in Photo 2 had a negative inpact on the stability of the piers.
Instead the inspector offered his “OPINION”.
That opinion was unsupported by any test.
That opinion turned out to be wrong.
My House is sinking and that needs to be corrected.
